These Terms of Use ("Terms") govern your use of Gymothee ("Gym Log & Workout Tracker," "the App," "we," "us," or "our").
By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.
1. Description of the App
Gymothee is a personal workout-recording application that allows users to record, organize, and review exercise and fitness information.
Features may include:
- Exercise tracking
- Weight and repetition tracking
- Cardio tracking
- Workout history
- Progress visualization
- Measurement-unit conversion
- Local data storage
- CSV data export and import
- Appearance and other App settings
Features may change over time as the App is updated.
2. Personal Use
Gymothee is intended for personal fitness tracking and organizational purposes.
You are responsible for the information you enter into the App and for maintaining appropriate backups of information you wish to preserve.
Because workout records may be stored locally on your device, you should periodically export important information if you do not want to risk losing it through device failure, App deletion, operating-system changes, or other circumstances.
3. Not Medical Advice
Gymothee is not a medical device and is not a substitute for professional medical advice, diagnosis, treatment, or supervision.
Information displayed by the App—including workout records, statistics, graphs, trends, and other calculations—is provided for general informational and personal record-keeping purposes.
The App does not determine whether a particular exercise, weight, repetition count, duration, or training program is safe or appropriate for you.
You should seek advice from an appropriately qualified healthcare or fitness professional when appropriate, particularly if you have a medical condition, injury, or other concern that could affect physical activity.
Do not rely on the App to determine whether you should begin, modify, or stop physical activity.
4. Accuracy of Information
Gymothee records information based on what you enter and performs calculations and displays based on that information.
We do not guarantee that:
- Information entered by you is accurate;
- Calculations will always be error-free;
- Imported data will always be interpreted correctly;
- Historical records will always remain available;
- The App will be available without interruption; or
- Every feature will operate on every device or version of an operating system.
You are responsible for checking important information before relying on it.
5. Data and Local Storage
Gymothee is designed to store your workout information locally on your device.
You are responsible for maintaining your device and protecting access to it.
We are not responsible for loss of locally stored workout information resulting from circumstances such as:
- Device loss or damage
- Device failure
- Accidental deletion
- Uninstallation of the App
- Operating-system changes
- Storage failure
- Other circumstances beyond our reasonable control
The App's CSV export functionality is provided to help you preserve your information.
6. Exported and Imported Data
Gymothee allows you to export workout information in CSV format and import compatible CSV data.
You are responsible for reviewing imported data and ensuring that it is appropriate before relying on it.
If you share an exported file with another application, service, person, or storage provider, you are responsible for that disclosure.
Third-party services are governed by their own terms and policies.
7. Intellectual Property
The App, including its software, design, interface, graphics, trademarks, logos, text, and other original materials, is owned by or licensed to the developer and is protected by applicable intellectual-property laws.
Except as expressly permitted by applicable law or these Terms, you may not:
- Copy or reproduce the App or substantial portions of it;
- Redistribute the App;
- Sell, rent, lease, or sublicense the App;
- Attempt to reverse engineer or decompile the App except where such activity cannot legally be restricted;
- Remove proprietary notices; or
- Use the App or its content to create a substantially similar competing product without appropriate authorization.
8. App Store and Device Requirements
Your use of the App may also be subject to the terms and conditions of the platform through which you obtained it, including Apple's applicable terms and conditions.
You are responsible for maintaining a compatible device and supported operating-system version.
9. Availability and Updates
We may modify, update, suspend, or discontinue features of Gymothee at any time.
We do not guarantee that a particular feature will remain available indefinitely.
Updates may be necessary to maintain compatibility with operating-system versions, security requirements, or other technical changes.
10. Acceptable Use
You agree not to use Gymothee:
- For unlawful purposes;
- To interfere with or compromise the App's operation or security;
- To attempt unauthorized access to systems or services associated with the App;
- To distribute malicious code through the App or its associated services; or
- In a manner that violates applicable law.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Gymothee is provided "as is" and "as available."
To the extent permitted by law, we disclaim warranties and conditions that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits any consumer rights or other rights that cannot legally be excluded or limited.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Gymothee.
This includes, to the extent permitted by law, loss of data, loss of profits, loss of business opportunities, or other intangible losses.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
13. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the Effective Date at the beginning of these Terms.
Your continued use of Gymothee after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
14. Termination
You may stop using Gymothee at any time by deleting the App from your device.
We may discontinue the App or particular features at any time, subject to applicable law and any obligations that cannot legally be excluded.
15. Governing Law
These Terms are governed by the laws applicable to the developer's place of establishment, except to the extent that mandatory consumer-protection laws in your jurisdiction provide otherwise.
Nothing in this section is intended to deprive consumers of mandatory protections available to them under the laws of their country or place of residence.
